If I have insurance, do I still need to see an attorney?

“Whenever you’re injured in an automobile accident you will first look to your own insurance policy to make sure you understand your coverage. On most Colorado auto policies there’s a component, it’s called a medical payment component. In most of those policies it’s a minimum $5,000 of medical care that will go to taking care of your injuries in an automobile accident regardless of fault. In a lot of cases that will be enough to take care of some people’s needs.

But, your insurance policy will also in many instances have what’s called underinsured or uninsured motorist coverage to take care of your claim in the event that the person who caused the accident was not insured or did not have proper amounts of insurance.

If you feel like you’ve been fully compensated by the other insurance company, the other insurance company is going to do what they can to get you to settle your claim as quickly as possible. They don’t care about your physical wellbeing. Understand they don’t want to have protracted negotiations with a client. They want it done quickly and they don’t care what your injuries are.

That’s why a lot of people who don’t have attorneys will get a call from the other insurance company. The other insurance company will try and put some money in their pocket very quickly. A very, very small amount and try and rid themselves of that client.

Our advice at our firm is to talk to an attorney. An attorney can at least evaluate the case; even if it’s not a claim that our firm would take. We can at least evaluate your case and give you a sense of whether or not you should be talking to this other insurance company, or whether or not this is a case that requires legal assistance.
There are many cases that we don’t take that I will have a discussion with a potential client about their injuries, about their needs, about their future losses. In many cases our firm will not represent someone if we believe that they are going to be adequately compensated through the insurance company without our involvement. But I believe it always helps a client or a potential client to at least talk to an attorney first, whether it’s my firm or any firm.

Any competent personal injury attorney will be able to evaluate your case and give you a sense of whether or not they need additional legal assistance. Or whether this is a claim that could likely be settled without an attorney. But I think it absolutely should always have an attorney involved to some degree.”
